• Legal Compliance: By using this Platform, you represent and warrant that you are legally capable of entering into these Terms and that you are not subject to any legal restrictions that might prevent you from using the services provided by Bossrec.

1.2 Account Registration

• Accurate Information: During registration, you must provide complete, current, and accurate information. This includes your name, email address, contact number, and any other required details.

• Account Security: You are responsible for maintaining the confidentiality of your account credentials. If you suspect any unauthorized use or breach of your account, you agree to promptly notify Bossrec.

• Account Management: You agree to update your account information if there are any changes. Failure to do so may result in service interruptions or limitations.

2.1 Nature of the Platform

• Marketplace Function: Bossrec functions as an online marketplace that connects Users with independent adventure tourism and recreational Operators. We act solely as an intermediary facilitating communication and transactions.

• No Direct Provision of Services: Bossrec is not the organizer or provider of the activities listed on the Platform. All services and events are provided by independent Operators, and any contract entered into is directly between you and the Operator.

2.2 Service Information

• Listings and Descriptions: All activities, including descriptions, pricing, schedules, and safety measures, are provided by Operators. Bossrec does not endorse any particular Operator, and Users are responsible for verifying details before booking.

• Service Changes: Operators may change or cancel activities. In such cases, Bossrec will assist in communicating updates and processing refunds or rescheduling, subject to the Operator's specific policies.

3.1 Booking Process

• Online Bookings: All bookings must be made through the Bossrec Platform. When you book an activity, you enter into a binding agreement with the Operator providing that service.

• Payment Authorization: Payment for bookings is made via our secure payment gateway. You authorize Bossrec to collect the full payment on your behalf at the time of booking.

• Confirmation: A booking is only confirmed once the payment is processed. You will receive an electronic confirmation containing the details of your booking, which you should retain for reference.

3.2 Payment and Refunds

• Payment Terms: All charges, including applicable taxes and fees, are clearly stated at the time of booking.

• Refund Policy: Refunds are governed by the specific cancellation policies of the Operator. You are responsible for reviewing the Operator's cancellation and refund policy before booking.

• Cancellation by Operator: If an Operator cancels the activity, you may be entitled to a full refund or a rebooking option, subject to the Operator's policy. Bossrec will facilitate this process but is not liable for any delay.

3.3 Disputes and Chargebacks

• Dispute Resolution: In the event that you have a dispute concerning a booking or payment, please contact Bossrec support immediately. We will work with both you and the Operator to resolve the issue.

• Chargebacks: Unauthorized chargebacks may result in account suspension, and you are responsible for any associated administrative fees. Bossrec reserves the right to investigate and take appropriate legal actions if needed.

4.1 Personal Responsibility and Health

• Fitness and Safety: You confirm that you are physically and mentally fit to participate in the activities booked. You acknowledge that adventure and recreational activities involve inherent risks including physical injury, and you participate at your own risk.

• Medical Insurance: While Bossrec is not responsible for providing any insurance, you are advised to have appropriate medical or travel insurance coverage.

4.2 Conduct and Behavior

• Professional Conduct: You agree to act in a respectful, lawful, and courteous manner when interacting with Operators and other Users.

• Compliance with Rules: You must comply with any rules, instructions, or safety guidelines provided by the Operator at the time of the activity. Failure to follow these may result in your removal from the activity, and you may forfeit any refund rights.

4.3 Use of the Platform

• Accuracy of Information: When providing reviews or feedback, ensure that your statements are truthful and reflective of your experience.

• No Misuse: You agree not to engage in fraudulent, deceptive, or unethical behavior. Misuse of the Platform may lead to termination of your account and possible legal consequences.

5.1 Limitation of Liability

• Role of Bossrec: Bossrec is not the provider of the services listed on the Platform and shall not be liable for any direct, indirect, incidental, or consequential damages arising from your participation in any activities.

• Personal Responsibility: You acknowledge that you participate in adventure activities at your own risk and that any injuries, illnesses, or damages incurred as a result of the activities are your responsibility.

5.2 Disclaimers

• No Warranties: The Platform, including all listings and information provided, is offered "as is" without warranties of any kind, either expressed or implied.

• Information Reliance: While Bossrec strives to keep information up-to-date and accurate, we do not guarantee the accuracy, completeness, or reliability of any information on the Platform. Users should verify details directly with the Operators.

5.3 Indemnification

• User Liability: You agree to indemnify, defend, and hold harmless Bossrec, its affiliates, and its staff from any claims, liabilities, or expenses (including legal fees) arising from your breach of these Terms or your participation in any activities booked through the Platform.

6.1 Ownership of Content

• Bossrec Content: All content on the Platform (text, graphics, logos, images, and software) is the property of Bossrec or its licensors and is protected by intellectual property laws.

• User-Generated Content: When you submit content such as reviews or comments, you grant Bossrec a non-exclusive, perpetual, and royalty-free license to use, reproduce, modify, and distribute the content for any lawful purpose.

6.2 Restrictions

• Prohibited Actions: You may not copy, distribute, or create derivative works of any content on the Platform without explicit permission.

• Third-Party Rights: You are responsible for ensuring that any content you post does not infringe on the intellectual property rights of others.

• Legal Action: If a dispute cannot be resolved through negotiation or mediation, it will be subject to the exclusive jurisdiction of the courts located in Malaysia.

10.1 Entire Agreement

• These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Bossrec regarding the use of the Platform.

10.2 Severability

• If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

10.3 Waiver

• Failure by Bossrec to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.
